Register of building work orders

A register of in-force prohibition orders, building work rectification orders, stop work orders, and enforceable undertakings for buildings with residential apartments.

Key information

The NSW Building Commissioner may make an order prohibiting the issue of an occupation certificate and/or the registration of a strata plan for a residential apartment building when:

  1. an expected completion notice was not given or was given less than 6 months before the application for the occupation certificate was made
  2. an expected completion amendment notice was not given or was given less than 6 months before the application for the occupation certificate was made
  3. a serious defect in the building exists
  4. a building bond has not been given
  5. the relevant regulated design were not followed
  6. relevant documentation and/or compliance declarations related to building work have failed our design and building practitioner audit.

How orders are issued

Orders are issued by the Building Commissioner under the Residential Apartment Buildings (Compliance and Enforcement Powers) Act 2020 and can include a stop work order (section 29), prohibition order or a building work rectification order.

Stop work orders are also issued under the Design and Building Practitioners Act 2020.

Design and Building Practitioner (DBP) Undertakings

A DBP undertaking is when an entity registered under the Design and Building Practitioner (DBP) legislation and the Secretary of the New South Wales Department of Customer Service agree that certain actions will be performed as a condition of their DBP registration.

It is a voluntary undertaking and a sign of good faith by the entity that they want to demonstrate their suitability to hold registration.

Developer Undertakings

A developer undertaking is when a developer and the Secretary of the New South Wales Department of Customer Service agree to fix serious defects in a strata building at the developer's own cost.

It is a voluntary undertaking and a sign of good faith by a developer that they want to make the building work right.
